Red Circle Foundation reserves the right to refuse service, terminate accounts, and/or cancel orders at their discretion, including, without limitation, if Red Circle Foundation believes the customer’s conduct violates applicable law(s) or is harmful to the interests of Red Circle Foundation.


All content included on the site (text, graphics, logos, button icons, images, software etc.) is the property of Red Circle Foundation or its content suppliers and is protected by U.S. and international copyright laws. Compilation of all content on the Site is the exclusive property of Red Circle Foundation and is protected by U.S. and international copyright laws. The Site’s content and software may be used as a shopping resource. Any other use, including reproduction, modification, distribution, transmission, republication, or public performance, is strictly prohibited. All rights reserved.


General Information. Our site is primarily meant to provide you with information about Red Circle Foundation events and about our company. While we try to keep our site up-to-date and accurate, we take no responsibility for any incorrect information on the site.


Our website may also include: surveys to help us learn about you or your interest in volunteering at an event, hosting an event, or being part of a news story about an event; newsletter sign-up; and a poster request form. We do not guarantee any confidentiality or anonymity with respect to any information you provide to us. By submitting information, photos or other materials to us through the website or via email you: 1) give us permission to use them for any legitimate purpose and 2) represent and warrant that you have the right to permit us to use them for such purpose. For example, if you fill out our Media Profile survey and email us your photo, we will understand that we have your permission to among other things: shop your story and photo to any media outlets we choose, put them in touch with you and give them permission to use your photo and story.

EVENT REGISTRATION (Participant and Spectator)

Signing-up to participate in or watch an event requires creation of an account and registration through a third party website. The information you provide to our third party provider to register for a Red Circle Foundation event will be shared with us, but the provider has its own terms of use and privacy policy. We are not responsible for your account with any third party provider or any information you provide to the third party to create an account. You must contact this third party provider for any issues with your account. Review our privacy policy for more on how we use any information we collect from you.


In addition to the third party providers that handle event registration our website may contain links to third-party websites that are not owned or controlled by us. We assume no responsibility for, the content, products, services, policies, or practices of any third-party websites.


Unless otherwise specified, intellectual property rights in and to the material on our site is owned by Red Circle Foundation. No material from our site may be copied, republished, uploaded, posted, transmitted, or distributed, except that you may download one copy of the materials on any single computer for your personal, noncommercial home use only, provided you keep intact all copyright and other proprietary notices. Use of the materials for any other purpose is a violation of our copyright and other proprietary rights.


When you submit something to us (e.g. information, photos/videos, or other items) or create an event to fundraise on behalf of Red Circle Foundation all submissions and event names become property of Red Circle Foundation. You grant us a perpetual, worldwide right to modify, reproduce, distribute, publicly display and perform what you have submitted, including your name and likeness, and allow others to do the same for any legitimate purpose, including commercial purposes. You agree that you will not receive any compensation for or not make any claim in connection with our exercise of the permissions you have granted us, including a claim based on invasion of privacy, publicity, idea misappropriation or other civil rights or defamation. Red Circle Foundation shall exclusively own all known or later existing rights to the Submissions worldwide and shall be entitled to the unrestricted use of the Submissions for any purpose in all media now known or hereafter discovered without compensation to the provider of such Submissions.


You expressly agree that use of the Site is at your own risk. Red Circle Foundation does not promise the Site will be error free or uninterrupted, or that it will provide specific results from use of the Site content. The Site and its content are delivered on an “as available” basis without warranties of any kind, either express or implied, including, but not limited to, warranties of merchantability or fitness for a particular purpose.

Except in jurisdictions where such provisions are restricted, in no event will Red Circle Foundation be liable for any indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profits, even if Red Circle Foundation has been advised of the possibility of damages. This disclaimer of liability applies to any and all damages or injury from any cause. These include, without limitation, damages or injury caused by failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction, or unauthorized access to, alteration of, or use of record, whether for breach of contract, tortuous behavior, negligence, or under any other cause of action.
